ProgressOhio Files Lawsuit to Shackle Kasich's Prison ...

Included among the complaints arguments:

the selling of state owed prisons to private contractors is unconstitutional and unenforceable; asks the court to declare that prison workers that are employed by privatized prisons are public employees; calls for an injunction preventing Kasich's administration from moving forward with the plan including barring any layoffs of current prison employees and the sale of the public assets.

The lawsuit challenge centers on violation of Article 2 Section 15D known as the single subject law and under this provision it could impact number of issues unrelated to appropriations in the State budget.

In addition the lawsuit alleges that by putting the matter in a budget bill it eliminates the rights of Ohioans to referendum and similar to ProgressOhio's previous challenge of JobsOhio cites a violation of Article 4 Section 8 of the Ohio Constitution which specifically prohibits the joining of the property interests of the State and a private contractor. "By filing today over these Constitutional issues, we believe strongly that this case preserves a safe environment for these communities that house dangerous felons and preserves good jobs in an Ohio economy wracked by income deflation. In effect this action protects both safety and economic security for Ohio communities whose residents would see profit over safety and layoffs and pay cuts that will devastate consumer spending." "Clearly these provisions both violate the single subject law of the Ohio Constitution, deprive Ohioans of the right to a citizen veto and violates the Constitutional prohibition of the state in using its full faith and credit to invest its assets in a private corporation. It is on its face a pretty clear violation of Ohio's supreme legal document.
